What Does Article 7 Say?

Article 7 of the Constitution of The Bahamas provides a legal pathway to citizenship for certain persons born in The Bahamas after Independence.

“A person born in The Bahamas after 9th July 1973 neither of whose parents is a citizen of The Bahamas shall be entitled, upon making application on his attaining the age of eighteen years or within twelve months thereafter in such manner as may be prescribed, to be registered as a citizen of The Bahamas.”

The Constitution further explains that if the applicant already holds citizenship in another country, they must renounce that citizenship before being registered as a citizen of The Bahamas. They must also take the Oath of Allegiance and complete any declarations concerning residence as prescribed by law.

Who Qualifies Under Article 7?

Born in The Bahamas

The applicant must have been born in The Bahamas after 9th July 1973.

Non-Bahamian Parents

Neither parent could have been a Bahamian citizen at the time of the applicant’s birth.

Age Requirement

The application must be submitted after turning 18 years old and before the applicant’s 19th birthday.

The Law: Article 7 of the Constitution of The Bahamas

“A person born in The Bahamas after 9th July 1973 neither of whose parents is a citizen of The Bahamas shall be entitled, upon making application on his attaining the age of eighteen years or within twelve months thereafter in such manner as may be prescribed, to be registered as a citizen of The Bahamas:

Provided that if he is a citizen of some country other than The Bahamas he shall not be entitled to be registered as a citizen of The Bahamas under this Article unless he renounces his citizenship of that other country, takes the oath of allegiance and makes and registers such declaration of his intentions concerning residence as may be prescribed.”

How to Apply

Individuals who qualify under Article 7 are entitled to register as citizens of The Bahamas upon making an application to the Department of Immigration using Form 2.

Steps to Completing the Application Form

  1. Complete the application form in its entirety except for Page 3, which bears the Oath of Allegiance.
  2. The Oath of Allegiance process is completed only after approval of the application and during the official swearing-in process as a citizen of The Bahamas.
  3. Attach all required supporting documents. A complete listing of required documents is available on the Department of Immigration website.
  4. Ensure the form is notarized or certified by:
    • A Notary Public
    • An Attorney-at-Law
    • A Justice of the Peace
  5. The notarization process is completed on Page 2 of the application form.
